Terms of Use Last update 2 days ago
Welcome to Workerr. These Terms of Use ("Terms") govern your access to and use of the Workerr website, services, and applications (collectively, the "Platform"). By creating an account or using Workerr, you agree to comply with and be bound by these Terms. If you do not agree, please do not use the Platform.
1. Platform Overview
Workerr is an online marketplace that connects independent service providers ("Freelancers") with businesses or individuals seeking services ("Clients"). Workerr acts strictly as an intermediary facilitator. Freelancers are independent contractors and are not employees, agents, or partners of Workerr.
2. Account Registration and Security
- Eligibility: You must be at least 18 years old and capable of forming legally binding contracts to register an account.
- Account Information: You agree to provide accurate, current, and complete information during registration and to keep your account details updated.
- Account Security: You are responsible for safeguarding your login credentials and for all activities that occur under your account. Notify Workerr immediately of any unauthorized use.
3. Orders, Contracting, and Delivery
When a Client places an order or accepts a contract proposal from a Freelancer on Workerr, a legal agreement is formed directly between the Client and Freelancer. Workerr is not a party to any contract between users.
- Scope of Work: Freelancers must deliver completed work according to the specifications, deadlines, and requirements stated in the agreed order.
- Revisions: Any revisions must adhere to the scope defined at the start of the order unless both parties agree to a modified scope or extra fee.
4. Financial Terms and Escrow
- Payments: Clients agree to pay all charges associated with an order upon purchase or contract creation. Workerr holds funds securely in escrow during project execution.
- Payouts: Escrowed payments are released to the Freelancer upon Client approval of the final deliverables or automatically after the designated review period expires without dispute.
- Platform Fees: Workerr charges processing and service fees to Clients and/or Freelancers as detailed on our Pricing page at the time of transaction. All fees are non-refundable unless specified otherwise.
- Off-Platform Payments: Attempting to pay or receive payment outside of Workerr for work initiated on the Platform is strictly prohibited and constitutes grounds for immediate account termination.
5. Intellectual Property and Ownership
- Work Product: Unless explicitly agreed otherwise in writing between Client and Freelancer, once full payment is received and approved, all intellectual property rights in the delivered work product transfer exclusively to the Client.
- Pre-Existing Assets: Freelancers retain rights to their pre-existing materials, frameworks, or tools incorporated into a deliverable, granting the Client a perpetual, royalty-free, non-exclusive license to use them as part of the delivered project.
- Workerr Platform IP: All logos, design elements, software, text, and proprietary graphics on Workerr belong strictly to Workerr.
6. User Conduct and Content Guidelines
You agree not to post, submit, or transmit any content or behave in a manner that:
- Is unlawful, fraudulent, defamatory, discriminatory, or harassing.
- Infringes on third-party intellectual property or privacy rights.
- Distributes viruses, malware, or harmful computational code.
- Involves spamming, scraping, or automated collection of user data without consent.
- Circumvents Workerr’s communication channels, escrow payment system, or fee structure.
7. Dispute Resolution
Clients and Freelancers are encouraged to resolve order issues directly through Workerr’s messaging system. If a dispute cannot be resolved informally, either party may request Workerr Dispute Resolution support within the designated order dispute window. Workerr’s determination regarding escrow releases in disputes is final and binding.
8. Limitation of Liability and Disclaimers
Workerr is provided on an "as is" and "as available" basis without warranties of any kind, express or implied. Workerr does not guarantee the quality, safety, legality, or suitability of any services provided by Freelancers. To the maximum extent permitted by law, Workerr shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Platform.
9. Termination
Workerr reserves the right to suspend or terminate your account and access to the Platform at any time, with or without notice, for conduct that violates these Terms or is harmful to other users or the platform’s operations.
10. Changes to Terms
We may update these Terms from time to time. Changes will be posted on this page with an updated revision date. Continued use of the Platform following any modifications indicates your acceptance of the revised Terms.
